Participant Liability & Assumption of Risk Disclaimer
Effective Date: April 2025
Please read this disclaimer carefully before booking a trip with Nadia Embroidery Travel. By completing your registration and paying your deposit, you acknowledge that you have read, understood, and agreed to the terms set out below.
Nadia Embroidery Travel acts solely as a trip organizer and intermediary. Each participant travels at their own risk and is fully responsible for their personal safety, health, belongings, and travel arrangements.
1-ASSUMPTION OF RISK
Travel, by its nature, involves inherent risks that cannot always be anticipated or eliminated. By joining a Nadia Embroidery Travel group tour, you voluntarily assume all risks associated with travel, including but not limited to:
Physical injury, illness, or death resulting from activities during the trip
Loss, theft, or damage to personal property or luggage
Delays, cancellations, or disruptions to transport or accommodations
Exposure to unfamiliar foods, climates, or environments
Civil unrest, geopolitical developments, or changes in government travel advisories
Acts of nature including earthquakes, floods, or extreme weather
Any risks inherent to the destination country or region
2-LIMITATION OF LIABILITY
Nadia Embroidery Travel, its owner, employees, contractors, local guides, and partner suppliers shall not be held liable for any loss, injury, damage, additional expense, or inconvenience caused directly or indirectly by:
Events beyond our reasonable control, including force majeure events
The actions or negligence of third-party suppliers (airlines, hotels, transport providers, local guides)
A participant's failure to follow safety instructions or group guidelines
A participant's pre-existing medical condition or undisclosed health issues
Political instability, terrorism, or government-imposed travel restrictions
Pandemics, epidemics, or public health emergencies
Our total liability to any participant, where applicable under law, shall not exceed the total amount paid by that participant for the specific trip in question.
3-PERSONAL RESPONSIBILITY
Each participant is solely responsible for:
Ensuring they hold a valid passport and all required visas for their destination
Obtaining and maintaining comprehensive travel, medical, and cancellation insurance — this is a mandatory condition of booking with us
Disclosing any medical conditions, physical limitations, or dietary requirements prior to departure
Following all local laws, customs, and regulations at the destination
Managing their own medications and personal health needs throughout the trip
Arriving on time for all scheduled departures; we cannot delay groups for late individuals
4-HEALTH & MEDICAL DISCLAIMER
Nadia Embroidery Travel does not provide medical advice and is not responsible for the health outcomes of any participant. We strongly recommend consulting a travel medicine physician before departure, particularly for destinations that require vaccinations or carry specific health risks.
In the event of a medical emergency during a trip, Nadia Embroidery Travel staff will assist in facilitating access to local emergency services. However, all costs associated with medical treatment, evacuation, or repatriation are the sole responsibility of the participant and their insurer.
5-TRAVEL ADVISORY ACKNOWLEDGEMENT
Participants are responsible for reviewing and understanding the travel advisories issued by their home country's government for all destinations on their itinerary. Nadia Embroidery Travel monitors conditions and reserves the right to modify, postpone, or cancel a trip if we determine that participant safety is at risk.
The existence of a travel advisory for a nearby region or country does not, in itself, constitute grounds for a refund or cancellation without penalty, provided the specific destination remains safe and accessible. Participants are reminded that this is precisely why comprehensive travel insurance, including Cancel for Any Reason (CFAR) coverage, is required.
6-AGREEMENT & ACCEPTANCE
By registering for and paying a deposit on any Nadia Embroidery Travel tour, you confirm that:
You are 18 years of age or older, or are traveling with a legal guardian
You have read and understood this disclaimer in full
You voluntarily accept the risks described herein
You have purchased, or commit to purchasing, adequate travel insurance prior to departure
You release Nadia Embroidery Travel from liability to the fullest extent permitted by applicable law
This disclaimer does not affect any statutory rights you may have under applicable consumer protection law in your country of residence. We recommend seeking independent legal advice if you have any questions about your rights.
Nadia Embroidery Travel recommends that all participants seek independent legal and insurance advice before booking.
